Convention Overlook House Rules

The Board of Directors of Convention Overlook has implemented the Convention Overlook House Rules to be used as a guide for all residents of 430 West 34th Street. These rules are set forth for the purpose of safety, guidance, respect and general knowledge for those who reside here.

Emergency Contact and Pet Information:

All residents of 430 West 34th Street MUST complete an Emergency Contact and Pet Information sheet, on an annual basis. These sheets may be obtained by the superintendent or through Lawrence Properties.

Noise:

Noise levels should be kept to a level, at all times, which will not cause an ongoing disturbance to any neighbors. This includes television, radio or any conversation either in person or on the telephone. After 10:00 P.M. on weeknights and Midnight on weekends, (Friday and Saturday) noise levels should be kept to a minimum.

Garbage:

Newspapers, magazines, periodicals, cleaned out cans and bottles (both plastic and glass) should be placed in the recycle bins located on each floors staircase or in the blue recycle bins located in the basement.

All broken bottles, light bulbs, ceramic ware or glass ware should be placed in a bag and labeled “BROKEN” and placed in the recycle bins.

Any wet garbage should be placed in the trash compactor chute. Before throwing garbage down the chute, make sure all garbage is securely tied in a plastic bag. DO NOT throw glass objects down the compactor chute! Broken glass down the chute has and will damage the compactor. Do not attempt to stuff the trash compactor chute with garbage bags that do not fit. Large bulk garbage should be taken directly to the basement and left in the garbage area at the west side of the building. GARBAGE OF ANY KIND, ASIDE FROM RECYCLABLES, SHOULD NOT BE LEFT IN THE STAIRWAY RECYCLE AREAS.

ANYONE FOUND LEAVING NON RECYCLABLE GARBAGE IN THE STAIRWAY RECYCLE AREAS OR IN THE HALLWAY IS SUBJECT TO A FINE.

Move Ins/Move Outs:

Move ins/move outs are permitted Monday through Friday, 10:00 A.M.–4:00 P.M. No moves are permitted on the weekends.

Only one move is permitted per day and the elevator must be booked in advance with the front desk.

A refundable elevator deposit of $500.00 is required prior to move ins/move outs. Checks should be made to Convention Overlook and reference your apt. number in the “memo” section.

Repairs:

The individual shareholders are responsible for maintenance in their apartments.

If repairs are needed, the shareholder should notify the doorman or superintendent of the necessary repairs. Make sure you ask the superintendent about the fees associated with your repair. These fees will be charged on the preceding month’s maintenance bill.

Terraces:

Shareholders with terraces attached to their apartments must have their terraces inspected semi-annually, by the superintendent. It is the shareholder’s responsibility to make sure that the drains of the terraces are kept free of debris and clear of blocking obstacles. On an annual basis, all terraces will be inspected by the building’s engineer. The fee for this inspection will be passed onto the specific shareholder in the preceding maintenance bill. If it is the engineer’s professional opinion that any of the terraces are deemed to be over loaded with plants, furniture or other obstacles, and in turn may be harmful to the overall structure of the building, the shareholder will be required to remove ALL excess weight from that terrace, at the shareholder’s expense. Absolutely NO gas/charcoal grills or any form of fire pits (table fire pits included) are allowed on the building’s terraces. THIS IS A VIOLATION OF NYC FIRE CODE. Any shareholder found with any of the aforementioned devices on their terraces will be required to remove them IMMEDIATELY.

Unit Renovations:

In order to be cognizant of all residents within our building, all unit renovations or remodeling construction must be approved by the board before any work is to begin.

All plans and specifications, along with contracting licenses and insurance policies, should be sent to Lawrence Properties, care of Bernice Lugo. LP will review the plans and specifications and, if completed appropriately, will pass onto the board for consideration.

The board may not approve a renovation request, at the time of initial request, if construction has occurred on the same or the adjacent three floors within the previous month. If you know you are going to engage in a renovation, or need to have noisy construction work performed within your unit, please submit your request as early as possible, and be flexible on the time in which the project will start.

Contractors are permitted to work within the building from 10:00 A.M.–4:00 P.M. There is a $500.00 deposit, made out to Convention Overlook, required before any construction is permitted to begin. This deposit will be returned to the shareholder once work is completed and it is determined that no damage has occurred to the common areas of the building.

Keys:

The superintendent must have access to the shareholder’s apartment at all times. A copy of your key MUST be left with the superintendent.

If, in case of emergency, the superintendent needs access to any shareholder’s apartment and does not have a working key to that apartment, the superintendent will obtain access to that shareholder’s apartment via a locksmith at the shareholder’s expense.

Visitors/Service Deliveries:

Any visitor to the building must be announced by the doorman.

The doorman should be made aware of any expected deliveries/ repairman in advance.

If a resident is out of the apartment (on vacation, out for the weekend, etc.) and wants someone to stay in their apartment, it is permissible ONLY if a letter stating the visitor’s name and dates of use is left with the doorman IN ADVANCE of the stay. Telephone calls or emails to doormen, the superintendent, or board members are NOT permissible forms of communication regarding this requirement.

Roof-Top Garden Access:

All shareholders and their guests are more than welcome to enjoy the building’s roof-top garden. The roof-top is limited to shareholders of Convention Overlook and their guests ONLY. Since this roof-top is the property of all shareholders, no one shareholder is allowed to hold individual parties or reserve the roof-top garden for their individual entertaining. Tenants who reside at 430 W. 34th Street and rent, from either a shareholder or the sponsor, do not have roof access privileges. Guests of shareholders must be accompanied by the shareholder. Children under 12 must be accompanied by an adult at all times.

Access to the roof-top can be gained through Stairway A. Either of the building’s elevators may be taken to the penthouse level, at which point you must take the staircase up one flight to the roof. All access to the roof is gained through a keyed door, through which a defined path will take you to the garden area. One access devise will be provided per shareholder unit. If the devise is lost, another may be requested at the expense of the shareholder.

The building’s roof-top garden area is defined by fencing. NO ONE IS PERMITTED OUTSIDE THE DEFINED GARDEN AREA! NO EXCEPTIONS! The area is under camera surveillance, and is monitored on a continual basis.

The roof-top garden can be accessed daily from 8:00 A.M.–10:00 P.M., whether permitting. During off hours, and during inclement weather, the roof-top door is armed with an alarm that will sound upon opening.

Smoking, liquor, and music are strictly prohibited from the building’s roof-top garden (earphones, iPods, and mp3 players, are acceptable).

Storage:

Shareholders may obtain a storage unit, located in the basement, for a fee, if available. Storage units are priced per size of the unit. Check with the superintendent if you are interested in this service. The rental of storage units is limited to shareholders.

No hazardous material may be kept in the storage room.

Materials left outside the shareholder’s storage unit will be discarded.

There is a limit of two storage units per Shareholder apartment (i.e.; if two or more individuals own shares to one or more apartments, they, together, are limited to renting two storage units).

Windows:

Nothing is to be thrown out of any windows! Individuals found doing so are subject to a fine and are any applicable legal action.

Pets:

Pets are welcome at 430 West 34th Street; however, all pets are subject to board approval and MUST be disclosed to the board before they are housed within the building. Pets are generally limited to two pets per unit; however, exceptions may be made under extreme circumstances. Exotic pets, such as reptiles, mice or rats are not permitted.

Carpets:

80% of all apartment floors must be covered with carpeting, if there are noise complaints from your neighbors.

Subletting of Apartments:

Although it is the intention of the Corporation for all shareholders to occupy the apartments associated with their specific shares, shareholders are permitted to sublet their apartments after they have been a shareholder for two years, or in urgent circumstances as defined by the Board.

For new sublets, a shareholder must:
  • Obtain and submit a rental application to Lawrence Properties. It is the shareholder’s responsibility to determine the credit worthiness of the potential renter.
  • Schedule an interview of the renter with the Convention Overlook Board. Interviews can be scheduled through Lawrence Properties. All sublets are subject to Board approval.
  • Remit an application fee of $250.00 made payable to Lawrence Properties and $100.00 made payable to Convention Overlook.
  • Provide Lawrence Properties a copy of the rental agreement between the shareholder and the renter. (All sublets are subject to a minimum one year rental agreement.)
For a sublet renewal, a shareholder must:
  • Submit a renewal request letter to Lawrence Properties.
  • Remit a sublet renewal fee of $150.00 made payable to Convention Overlook. (Sublet renewals are subject to Board approval, although no interview is required.)

If a shareholder is not in good standing with Convention Overlook, the Board reserves the right to revoke sublet approval at ANY TIME.

During the term of the sublet, the shareholder remains responsible to Convention Overlook for the maintenance fee, any assessments, and any other charges.

All shareholders who sublet their apartments are subject to a monthly sublet fee. This fee is determined by the number of shares owned by the shareholder. The calculation equates to $.48 per share owned. For example, if a shareholder rents out his/her apartment and the shares associated with that specific apartment are 250, the shareholders monthly sublet assessment would be $120.00 per month (250 x $.48 = $120).

All sublet fees will be assessed on a monthly basis.

Financing Apartments:

Shareholders may finance up to 80% of the appraised value of their apartment. If a shareholder wishes to obtain a loan, line of credit, or refinance a loan for their shares of Convention Overlook, the shareholder must contact Lawrence Properties, indicate their intentions, and provide a package of the following documents to Lawrence Properties for Board review:

  • A letter from the shareholder indicating the reason for refinance, line of credit or mortgage;
  • Copy of the loan application;
  • Copy of the financial institution’s Commitment Letter;
  • Original Recognition Agreement (Aztech form) signed by the shareholder and lending institution, in triplicates;
  • Copy of the Appraisal Report;
  • Copy of the Loan Commitment Letter; and
  • In cases of a line of credit, a bank statement verifying the current monthly mortgage payment.

If the shareholder’s proposed total monthly payments are greater than the total current payments, then please include:

  • The most recent Federal Income Tax Return (including W2);
  • The Lawrence Properties’ Credit Report Release Form; and
  • A financial statement with verification of assets listed.

Two fees of $250.00 each are required. One made payable to Lawrence Properties, and the other made payable to Convention Overlook. (Applicable to purchases only.)

** The board requires a 30 DAY time period to review all forms of applications submitted to them. This time period starts once the board receives the documents from Lawrence Properties. **
